In recent months, the code has been sternly <a href=\"https:\/\/cihrs.org\/egypt-exceptional-code-of-criminal-procedures-undermines-justice\/?lang=en\">criticized<\/a> by human rights organizations, the Lawyers\u2019 Syndicate, the Journalists\u2019 Syndicate, the Judges\u2019 Club, and <a href=\"https:\/\/www.cfjustice.org\/egypt-cfj-welcomes-un-letter-warning-of-the-dangers-of-proposed-amendments-to-the-criminal-procedure-law-calls-on-authorities-to-amend-freedom-restricting-legislation\/\">UN human rights mechanisms<\/a>. Nonetheless, the Egyptian authorities\u2019 determination to move forward with it comes as no surprise.<\/p>\n<p style=\"text-align: justify;\">The new code devastates basic foundations of the rule of law and human rights guarantees, providing institutional cover for the extralegal practices and policies that have been instituted over the past decade. As our organizations have <a href=\"https:\/\/cihrs.org\/egypt-crisis-by-design-a-human-rights-report-by-independent-egyptian-organizations-to-the-un\/?lang=en\">previously warned,<\/a> these policies and practices are neither technical in nature, nor a necessary evil to face security threats; they are part and parcel of the authoritarian philosophy of governance embraced by President Abdelfattah al-Sisi. Further institutionalization of Egypt\u2019s human rights crisis using the new code remains consistent with the authorities\u2019 track record.<\/p>\n<p style=\"text-align: justify;\">At no point have the Egyptian authorities signaled genuine willingness to address this crisis, the worst in decades. Our organizations have signaled from the start that previous initiatives such as the <a href=\"https:\/\/cihrs.org\/egypt-national-strategy-for-human-rights-a-ruse-to-show-international-community-and-donor-states-that-political-reform-is-underway\/?lang=en\">National Human Rights Strategy<\/a> and the <a href=\"https:\/\/cihrs.org\/egypt-cihrs-position-paper-on-the-national-dialogue\/?lang=en\">National Dialogue<\/a> are hollow endeavors that have merely sought to provide smokescreens neutralizing criticism of Egypt\u2019s human rights record. Our organizations also <a href=\"https:\/\/cihrs.org\/egypt-third-sisi-presidential-term-would-undermine-state-stability-and-prevent-the-initiation-of-human-rights-and-economic-reform\/?lang=en\">warned<\/a> over a year ago that a third term for President Sisi \u2013 secured through an unfair and uncompetitive process denying Egyptians their rights to political participation \u2013 preempts any potential for reforming or alleviating the nation\u2019s festering human rights<span class=\"Apple-converted-space\">\u00a0 <\/span>crisis. For those who doubted these assessments, including Egypt\u2019s international partners, the Parliament\u2019s adoption of the new code of criminal procedures should leave no room for uncertainty regarding the authorities\u2019 intent. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">Our organizations reiterate our rejection of the new code of criminal procedures, together with the arsenal of draconian legislation adopted over the previous decade, including on counterterrorism, which provide more legal cover for the authoritarian <i>status quo<\/i> while violating rights guarantees provided in Egypt\u2019s Constitution and many of the international conventions and treaties it has ratified.
