If the EU fails to address Egypt\u2019s <a href=\"https:\/\/www.hrw.org\/news\/2023\/09\/20\/how-brute-violence-became-egypts-answer-virtually-everything\">human rights and accountability crisis<\/a>, focuses on curbing migration by reinforcing Egyptian security bodies and the military, and funds the Egyptian State without prior reforms, such a short-sighted approach would not tackle Egypt\u2019s <a href=\"https:\/\/www.crisisgroup.org\/middle-east-north-africa\/north-africa\/egypt\/eygpt-in-the-balance\">chronic instability<\/a> issues, and rather would lead to reinvigorating <a href=\"https:\/\/bti-project.org\/en\/reports\/country-dashboard\/EGY\">authoritarianism <\/a>there, proving counter-productive. Egypt\u2019s <a href=\"https:\/\/www.middleeastmonitor.com\/20231204-currency-inflation-woes-in-focus-as-egypts-sisi-set-for-third-term\/\">dire economic straits<\/a> and its <a href=\"https:\/\/cihrs.org\/the-national-strategy-two-years-of-denying-the-ongoing-human-rights-crisis\/?lang=en\">human rights crisis<\/a> are related to the same underlying problems of unaccountable governance and the pursuit of regime survival before stability, which should be decisively addressed. Indeed, the increase in departures by boats of Egyptians in recent years from Libya is a direct result of the economic deterioration and pervasive repression produced by the government\u2019s policies which cannot go unaddressed.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Tackling Egypt\u2019s human rights and governance crises and restoring accountability<\/p>\n<p>If a new EU-Egypt strategic partnership materializes following negotiations in the coming weeks, it would directly follow Egypt\u2019s December 2023 <a href=\"https:\/\/egyptianfront.org\/2023\/12\/the-road-to-the-presidential-palace-part-1-overview-of-the-egyptian-presidential-elections-the-presidential-endorsement-phase\/\">presidential election<\/a>, held in a <a href=\"https:\/\/cihrs.org\/egypts-2024-presidential-elections-a-dead-end\/?lang=en\">thoroughly closed electoral environment<\/a> <a href=\"https:\/\/monitor.civicus.org\/country\/egypt\/\">without open civic space<\/a>, a <a href=\"https:\/\/www.hrw.org\/news\/2023\/11\/01\/egypt-dozens-peaceful-protesters-detained\">free public sphere<\/a>, <a href=\"https:\/\/eldh.eu\/en\/2022\/04\/egypt-focus-country-of-the-international-fair-trial-day-in-2022\/\">judicial independence<\/a> or <a href=\"https:\/\/bti-project.org\/en\/reports\/country-dashboard\/EGY\">checks on Executive power<\/a>. Such conditions <a href=\"https:\/\/cihrs.org\/egypts-2024-presidential-elections-a-dead-end\/?lang=en\">preclude any free or fair election<\/a>; the incumbent, President Abdelfattah al-Sisi\u2019s re-election is a <a href=\"https:\/\/www.rosalux.de\/en\/news\/id\/51203\/egypts-presidential-pantomime\">foregone conclusion<\/a>. Would-be candidates considered \u201cactual opposition\u201d such as <a href=\"https:\/\/cihrs.org\/egypt-sentencing-of-hesham-kassem-confirms-national-dialogue-is-a-farce-as-repeatedly-warned-by-rights-groups\/?lang=en\">Hisham Qassem<\/a> or <a href=\"https:\/\/cihrs.org\/egypt-al-tantawy-prevented-from-running-for-presidency-and-referred-to-trial-underscoring-illegitimacy-of-upcoming-elections\/?lang=en\">Ahmed al-Tantawy<\/a> have been <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2023\/11\/egypt-authorities-step-up-repression-ahead-of-presidential-elections\/\">prevented from running<\/a>. This <a href=\"https:\/\/worldjusticeproject.org\/sites\/default\/files\/documents\/Egypt.pdf\">highly repressive context<\/a> has provoked <a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-9-2023-0351_EN.html\">an urgency resolution<\/a> from the European Parliament, which<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>\u201c<i>Urges authorities to uphold the rule of law, freedom of expression, press, media and association, and judicial independence, to stop stifling opposition voices through arbitrary detention, digital surveillance, enforced disappearances and torture, to immediately and unconditionally release the tens of thousands of prisoners arbitrarily detained for peacefully expressing their opinion, including award winner Alaa Abdel Fattah and 20 journalists, and to lift online censorship against independent media\u2026<\/i>\u201d<\/p>\n<p>This election comes in the context of a severe and ongoing human rights crisis documented and recognized by multiple <a href=\"https:\/\/www.hrw.org\/world-report\/2023\/country-chapters\/egypt\">civil society organizations<\/a>, <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2021\/02\/un-experts-call-removal-rights-defenders-ramy-shaath-and-zyad-el-elaimy\">UN bodies<\/a> and <a href=\"https:\/\/maxlucks.de\/gemeinsame-erklarung-des-ausschusses-fur-menschenrechte-und-humanitare-lage-zur-lage-der-menschenrechte-in-agypten\/\">other<\/a> <a href=\"https:\/\/www.lachambre.be\/FLWB\/PDF\/55\/2815\/55K2815007.pdf\">institutions<\/a>. If the EU neglects to tackle such abuses, <a href=\"https:\/\/www.politico.eu\/article\/tunisia-president-kais-saied-migration-eu-human-rights\/\">it risks both perpetuating them and bolstering Egypt\u2019s authoritarian President A<\/a>l-Sisi. As Egypt suffers a<a href=\"https:\/\/www.crisisgroup.org\/middle-east-north-africa\/north-africa\/egypt\/eygpt-in-the-balance\"> prolonged economic and social crisis <\/a>which al-Sisi\u2019s <a href=\"https:\/\/foreignpolicy.com\/2023\/08\/09\/egypt-economy-debt-imf-sisi-mega-projects\/\">unaccountable governance is widely believed to have fueled<\/a>, a lucrative strategic partnership with Europe that neglects human rights would allow him to boast securing financial support without any concessions. This would <a href=\"https:\/\/www.swp-berlin.org\/10.18449\/2022RP12\/\">help the Executive and the military to avoid reform<\/a> and continue <a href=\"https:\/\/timep.org\/2023\/07\/03\/sisis-disastrous-decade\/\">wielding unchecked power in pursuit of the same unsustainable policies<\/a>, which promote <a href=\"https:\/\/cihrs.org\/egypt-third-sisi-presidential-term-would-undermine-state-stability-and-prevent-the-initiation-of-human-rights-and-economic-reform\/?lang=en\">instability and continued crisis<\/a>, and thus feed refugee and migration flows as <a href=\"https:\/\/dtm.iom.int\/europe\/arrivals\">people increasingly seek<\/a> a <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2021\/12\/un-experts-urge-release-rights-defenders-egypt-condemn-misuse-counter\">safe and dignified living elsewhere<\/a>. Therefore, the political framework for any EU-Egypt strategic partnership must explicitly acknowledge the reality and <a href=\"https:\/\/economic-research.bnpparibas.com\/html\/en-US\/Egypt-Dark-prospects-10\/18\/2023,48999\">serious nature<\/a> of these issues &#8211; including the human rights crisis &#8211; and effectively address them.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>No unconditional funding of abusive and unaccountable governance<\/p>\n<p>It is essential that the new EU-Egypt Strategic Partnership <b>subject any provision of direct and indirect EU financial support to Egypt,<\/b> t<b>o<\/b><a href=\"https:\/\/www.hrw.org\/news\/2023\/12\/06\/letter-eu-human-rights-conditions-strategic-partnership-and-enhanced-cooperation\"><b> clear, public and measurable conditions<\/b><\/a><b> in the areas of human rights and accountability, and spell out the relevant <\/b><a href=\"https:\/\/www.hrw.org\/news\/2022\/06\/15\/joint-ngo-letter-ahead-eu-egypt-association-council-meeting\"><b>benchmarks <\/b><\/a><b>to be met. <\/b>This should also apply to new funds from the <a href=\"https:\/\/euroefe.euractiv.es\/section\/economia-y-empleo\/news\/el-bei-inaugura-un-centro-regional-en-egipto-con-4-200-millones-de-dolares-para-inversiones\/\">European Investment Bank (EIB)<\/a><span class=\"Apple-converted-space\">\u00a0 <\/span>or the <a href=\"https:\/\/www.ebrd.com\/where-we-are\/egypt\/overview.html\">European Bank for Reconstruction and Development (EBRD),<\/a> and European encouragement of foreign direct investment in the country. Weakly conditioned financial support risks subsidizing the same policies that have led to Egypt\u2019s economic deterioration over the past decade.<\/p>\n<p>It is all the more crucial for EU and Member State direct budget support funds, whose use cannot be verified by donors; thus, they are particularly at risk of misappropriation, including for the benefit of entities involved in gross human rights violations. The allocation of new EU direct budget support funds to Egypt has been suspended since the 2013 <a href=\"https:\/\/www.consilium.europa.eu\/uedocs\/cms_data\/docs\/pressdata\/en\/foraff\/138599.pdf\">Foreign Affairs Council Conclusions<\/a> issued in response to the Rabaa and al-Nahda massacres (though sectoral development cooperation and civil society funding have continued). In recent years, the European Parliament has repeatedly <a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-9-2020-0384_EN.html\">warned against budget support for Egypt<\/a> due to its alarming human rights situation. The unconditional release of such funds today would give a distinctly harmful signal both of EU confidence and support for Egypt\u2019s unaccountable and unsustainable governance, and an EU belief the country\u2019s human rights situation has significantly improved.<\/p>\n<p>Hence, reform conditions must be clearly signaled in the overall EU-Egypt Strategic Partnership language and announcement, and spelled out in specific financial support agreements. The EU should set out concrete <b>benchmarks to restore some independence to state institutions, notably the <\/b><a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2019\/11\/egypt-permanent-state-of-exception-abuses-by-the-supreme-state-security-prosecution\/\"><b>judiciary <\/b><\/a><b>and State <\/b><a href=\"https:\/\/www.hrw.org\/news\/2022\/04\/04\/imf-prioritize-social-protection-egypt-loan-talks\"><b>anti-corruption and anti-fraud agencies<\/b><\/a>. To allow civil society and the media to play their crucial role to hold authorities accountable and foster inclusive governance, <b>Egypt\u2019s repressive legal framework and practices maintaining closure of the public sphere must be amended<\/b> (notably the <a href=\"https:\/\/cihrs.org\/wp-content\/uploads\/2023\/06\/GlobalCTStudyEgypt-.docx.pdf\">draconian Counter-Terrorism Law and Terrorist Entities Law<\/a> of 2015, <a href=\"https:\/\/www.accessnow.org\/press-release\/statement-opposing-egypts-legalization-of-website-blocking-and-communications-surveillance-2\/\">the Cybercrime Law,<\/a> the <a href=\"https:\/\/www.article19.org\/resources\/egypt-2018-law-on-the-organisation-of-press-media-and-the-supreme-council-of-media\/\">2018 Media regulation<span class=\"Apple-converted-space\">\u00a0 <\/span>Law<\/a>, <a href=\"https:\/\/cihrs.org\/wp-content\/uploads\/2017\/01\/Towards_the_em_of_Eg_eng.pdf\">Assembly Law no.10\/1914,<\/a> <a href=\"https:\/\/cihrs.org\/egypt-implementing-regulations-of-ngo-law-intended-to-cripple-civil-society\/?lang=en\">the 2019 NGO law<\/a>, and <a href=\"https:\/\/www.hrw.org\/news\/2021\/07\/15\/qa-legal-framework-and-environment-nongovernmental-groups-ngos-egypt#Q13\">Penal Code provisions<\/a> that hinder independent civic work). A clear change in the policy of punitive use of <a href=\"https:\/\/www.amnesty.org.uk\/press-releases\/egypt-mass-round-ups-ahead-cop27\">mass arbitrary detention in abusive conditions to silence dissent<\/a> &#8211; more than the release of a handful of symbolic individual cases &#8211; must be implemented. Concrete measures must be taken to tackle the <a href=\"https:\/\/www.hrw.org\/news\/2023\/09\/20\/how-brute-violence-became-egypts-answer-virtually-everything\">impunity <\/a>of security forces for crimes of <a href=\"https:\/\/www.amnesty.org\/en\/wp-content\/uploads\/2021\/05\/MDE1243312016ENGLISH.pdf\">enforced disappearance<\/a> and <a href=\"https:\/\/cihrs.org\/human-rights-organizations-submit-alternative-report-to-the-un-committee-against-torture-ahead-of-its-review-of-egypt\/?lang=en\">torture<\/a>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Tackling the risk of human rights violations within cooperation on migration<\/p>\n<p>In the field of migration and asylum, the EU must ensure any <a href=\"https:\/\/www.statewatch.org\/media\/4103\/eu-com-von-der-leyen-ec-letter-annex-10-23.pdf\">negotiations with Egypt<\/a> consistently highlight the alarming <a href=\"https:\/\/worldjusticeproject.org\/sites\/default\/files\/documents\/Egypt.pdf\">rule of law<\/a> and human rights issues. Just in the last two years, the Egyptian authorities have<a href=\"https:\/\/www.hrw.org\/news\/2023\/07\/13\/egypt-civilians-fleeing-sudan-conflict-turned-away\"> blocked people fleeing Sudan\u2019s conflict from entering without visas, creating life-threatening delays in access to asylum; <\/a>and violated the principle of non-refoulement by <a href=\"https:\/\/www.hrw.org\/news\/2022\/01\/27\/egypt-forced-returns-eritrean-asylum-seekers\">forcibly returning Eritrean asylum seekers<\/a> to Eritrea and <a href=\"https:\/\/cihrs.org\/egypt-arbitrary-detention-and-attempted-deportation-of-uyghur-asylum-seekers-condemned-by-rights-organizations\/?lang=en\">deporting Uyghur students<\/a> to China.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>They subject thousands of foreign nationals annually &#8211; <a href=\"https:\/\/rpegy.org\/wp-content\/uploads\/2022\/10\/EU-Funding-for-ECG-en.pdf\">according to Refugees Platform Egypt<\/a>, citing Egyptian Border Guard data &#8211; to indefinite arbitrary detention for entering Egypt irregularly, without access to UNHCR and in <i>\u201cextremely inhumane and bad conditions<\/i>\u201d in military or civilian facilities which independent rights organizations cannot access<i>. <\/i>Egyptian authorities have also <a href=\"https:\/\/www.hrw.org\/news\/2022\/03\/27\/egypt-police-target-sudanese-refugee-activists\">cracked down brutally on Sudanese refugee and asylum seeker activists<\/a> on Egyptian territory, while failing to protect refugees who suffered<a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/24\/egypt-sexually-abused-refugees-find-no-justice\"> sexual assault<\/a> or to uphold refugees\u2019 effective right to access basic services, noted the <a href=\"https:\/\/www.state.gov\/reports\/2022-country-reports-on-human-rights-practices\/egypt\/\">2022 US State Department report<\/a>.<\/p>\n<p>We recall the risks involved in the outsourcing of EU obligations to guarantee the right to seek asylum and to protect the rights of migrant people to non-safe countries, such as Egypt: this trend has resulted in channeling resources and know-how to unaccountable, untransparent authoritarian governments which fail to comply with human rights standards in migration management. The EU should adopt a prudent, do-no-harm approach in its migration cooperation talks with Egypt, and absolutely abstain from providing financial, technical or material support for Egypt\u2019s military and security bodies &#8211; in any framework &#8211; if it is to avoid <a href=\"https:\/\/rpegy.org\/wp-content\/uploads\/2022\/10\/EU-Funding-for-ECG-en.pdf\">risking complicity in the grave and widespread human rights violations<\/a> in this country. <a href=\"https:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=dtYoAzPhJ4NMy4Lu1TOebJtOzHl9Ya+xza+E+vtPfEMjvoay0x2iV30x2zj4TLGEMjRXVex9Q\/NhnR3\/ZHIww27bw4ZF3htxFLucJ9b7NxE=\">UN rights experts<\/a>, <a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/hrbodies\/upr\/midtermreports\/ngosmidtermreports\/egypt-upr-ngo-group-mid-term-en.pdf\">NGOs<\/a>, the <a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-9-2022-0426_EN.html\">European Parliament<\/a>, and country reports by the <a href=\"https:\/\/www.state.gov\/reports\/2022-country-reports-on-human-rights-practices\/egypt\/\">USA<\/a> or <a href=\"https:\/\/open.overheid.nl\/documenten\/ronl-b4104b81c523e3b37b614e3f5862f636dc4d3cb2\/pdf\">Netherlands <\/a>have reliably documented or denounced the involvement of forces under the Egyptian Interior Ministry\u2019s authority in <a href=\"https:\/\/dignity.dk\/wp-content\/uploads\/publication-series-38.pdf\">large-scale rights violations including torture, enforced disappearance,<\/a> <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2019\/10\/un-experts-urge-egypt-end-crackdown-protesters-and-human-rights-defenders\">mass arbitrary detention<\/a>, abuse and <a href=\"https:\/\/www.middleeastmonitor.com\/20230522-medical-neglect-the-gateway-to-slow-death-in-egypt-prisons\/\">medical neglect<\/a> in places of detention. At Egypt\u2019s <a href=\"https:\/\/cihrs.org\/egypt-government-evades-criticism-of-its-human-rights-record\/?lang=en\">2023 review<\/a> by the UN Committee Against Torture, independent rights groups <a href=\"https:\/\/cihrs.org\/wp-content\/uploads\/2023\/11\/EGYPT-CAT-2023-En.pdf\">submitting an alternative report<\/a><span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/cihrs.org\/human-rights-organizations-submit-alternative-report-to-the-un-committee-against-torture-ahead-of-its-review-of-egypt\/?lang=en\">called <\/a>for the practice of torture in Egypt to be qualified as a crime against humanity.<\/p>\n<p>The Egyptian military has also been involved in large-scale rights violations and war crimes, notably in North Sinai in recent years, as documented by several reports <a href=\"https:\/\/www.hrw.org\/news\/2019\/05\/28\/egypt-serious-abuses-war-crimes-north-sinai\">from Human Rights Watch<\/a> and the <a href=\"https:\/\/sinaifhr.org\/show\/148\">Sinai Foundation for Human Rights<\/a>, including mass arbitrary arrests, <a href=\"https:\/\/www.amnesty.org\/en\/wp-content\/uploads\/2021\/05\/MDE1243312016ENGLISH.pdf\">enforced disappearances<\/a>, torture, <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/08\/egypt-investigate-evidence-of-extrajudicial-executions-by-egyptian-army-in-north-sinai\/\">extrajudicial killings<\/a>, <a href=\"https:\/\/www.hrw.org\/news\/2021\/03\/17\/egypt-massive-sinai-demolitions-likely-war-crimes\">forced evictions and home demolitions<\/a>, as well as presumably unlawful air and ground attacks targeting civilians. The 2021 investigation by <a href=\"https:\/\/egypt-papers.disclose.ngo\/en\/chapter\/operation-sirli\">Disclose into \u201cOperation Sirli<\/a>\u201d (involving French-Egyptian military cooperation in reconnaissance flights for data gathering in the Western Desert) also shed light on a practice of likely extrajudicial executions by Egyptian forces. According to the leaked French military intelligence documents, Egyptian forces have used this information for years to carry out airstrikes primarily targeting smugglers of people and goods, and only secondarily for counter-terrorism purposes.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Hence, both new and ongoing EU-Egypt migration cooperation should include robust safeguards to ensure that no EU funds, equipment or other assets contribute to human rights violations or are provided to parties or institutions involved in human rights abuses \u2013 neither directly nor via Member States, international organizations or other third parties. If the EU now wishes to avoid the criticism it has faced before on its migration policy toward Libya or Tunisia, and to stand by its commitment to a \u201c<i>human rights-based, protection-oriented and gender-sensitive\u201d <\/i>approach with Egypt, it should ensure that the migration pillar of its Strategic Partnership with Egyptian authorities commits the latter to meet clear human rights benchmarks, and includes thorough due diligence measures. <i>Ex-ante <\/i>human rights impact assessments should be conducted based on clear benchmarks and published, before signature of agreements on activities. Independent, third-party monitoring mechanisms should be included to assess the human rights impact of activities under the agreement, and suspensive clauses should be applicable to the disbursement of funds, if and when activities are found to negatively impact human rights. Finally, the EU should learn from the shortcomings of past programs and prioritize transparency of the use of European funds for Egypt in the migration field from any instrument, including regional programs, and allow for scrutiny by the European Parliament.<\/p>\n<p>EU relations with Egypt now present a key test of Europe\u2019s ability and political will for a wise Strategic Partnership: will Europe pursue truly constructive cooperation with Egypt in the interests of medium-term stability, centering accountability, reform and rights, including the r<a href=\"https:\/\/fra.europa.eu\/en\/eu-charter\/article\/18-right-asylum\">ight to seek international protection<\/a>? Or will it follow the <a href=\"https:\/\/www.hrw.org\/news\/2023\/07\/20\/romes-anti-migration-summit-exposes-europes-growing-disregard-rights\">counter-productive approach<\/a> used in other deals with authoritarian leaders in the MENA region, which is short-sighted and profoundly dangerous for human rights &#8211; and in Egypt\u2019s case, would merely postpone the next crisis? In recent years, Egypt has been lurching from crisis to crisis and demonstrating the unsustainable nature of unaccountable governance that prioritizes regime survival over real stability and resilience, which it cannot achieve without the <a href=\"https:\/\/worldjusticeproject.org\/sites\/default\/files\/documents\/Egypt.pdf\">rule of law<\/a>, democratic governance and tangible human rights progress.
