{"id":2205,"date":"2023-05-03T13:29:34","date_gmt":"2023-05-03T13:29:34","guid":{"rendered":"https:\/\/egyptianforum.org\/?p=2205"},"modified":"2023-05-03T13:30:52","modified_gmt":"2023-05-03T13:30:52","slug":"egypt-detained-academic-at-risk-of-death","status":"publish","type":"post","link":"https:\/\/egyptianforum.org\/en\/egypt-detained-academic-at-risk-of-death\/","title":{"rendered":"Egypt: Detained Academic At Risk of Death"},"content":{"rendered":"<p style=\"font-weight: 400; text-align: center;\"><strong><em>Salah Soltan Should be Immediately Released, Offered Treatment<\/em><\/strong><\/p>\n<p style=\"font-weight: 400;\">(Beirut,\u00a0 May 3, 2023) \u2013 The\u00a0 Egyptian authorities should immediately release Salah Soltan, the arbitrarily detained father of a prominent US human rights defender, 51 human rights organizations said today. The authorities should ensure his immediate and urgent access to life-saving health care, and conduct effective and transparent investigations into reports that he has been tortured and otherwise ill-treated.<\/p>\n<p style=\"font-weight: 400;\">Soltan, 63, said in a letter leaked on March 20, 2023 that the authorities in Badr 1 prison, east of Cairo, have deprived him of adequate healthcare even though he suffers from life-threatening heart and liver diseases among other complex medical conditions. The deliberate denial of healthcare may amount to torture. Independent doctors said in letters addressing the Biden administration, which the family shared with rights groups, that they fear Soltan is at \u201cincreased risk of sudden death\u201d a decade after his initial arbitrary arrest and subsequent <a href=\"https:\/\/www.hrw.org\/news\/2015\/04\/19\/egypt-scant-evidence-mass-convictions\">unfair conviction on politicized charges<\/a>.<\/p>\n<p style=\"font-weight: 400;\">\u201cOn top of railroading him in an unfair trial, Egyptian authorities are deliberately abusing Salah Soltan\u2019s rights by failing to provide him with health care.\u201d said Adam Coogle, deputy Middle East and North Africa director at Human Rights Watch. \u201cThe authorities should at minimum transfer him to a qualified medical facility where independent health professionals can treat him without hindrance.\u201d<\/p>\n<p style=\"font-weight: 400;\">Before moving to the United States, Soltan was a professor of Islamic Law at Cairo University. He later founded and served as the president of the Islamic American University in Dearborn, Michigan from 1999 to 2004. As a legal US permanent resident, Soltan lived and worked in the USA for over a decade before his arrest in Egypt in September 2013 for opposing the military's ousting of elected president Mohamed Morsi. A court sentenced Soltan\u00a0 to life in prison in September 2017 in a mass trial\u00a0 marred by<a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/Documents\/Issues\/Detention\/Opinions\/Session83\/A_HRC_WGAD_2018_87.pdf\"> extensive due process and fair trial<\/a> violations. The United Nations Working Group on Arbitrary Detention<a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/Documents\/Issues\/Detention\/Opinions\/Session83\/A_HRC_WGAD_2018_87.pdf\"> determined<\/a> in 2018 that his arrest was arbitrary, as the authorities failed to provide credible evidence of wrongdoing, and that his prosecution violated the right to political participation and freedoms of peaceful assembly and expression.<\/p>\n<p style=\"font-weight: 400;\">In recent years, Soltan\u2019s<a href=\"https:\/\/www.hrw.org\/news\/2022\/02\/16\/egypt-rights-defenders-imprisoned-father-risk\"> family said<\/a>, the authorities have not provided him sufficient healthcare for chronic and new conditions, including diabetes, high blood pressure, hepatitis C, and a spinal disc condition, among others. The authorities have held him<a href=\"https:\/\/www.amnesty.org\/en\/documents\/mde12\/4996\/2021\/en\/\"> incommunicado several times<\/a>, sometimes for months, during which the family knew nothing about his health or whereabouts.<\/p>\n<p style=\"font-weight: 400;\">The Freedom Initiative, a DC-based human rights organization, has documented that the authorities in Badr 1 prison intentionally denied Soltan healthcare during two incidents in which he lost consciousness and had other serious symptoms. On December 18, 2022, Soltan said during a family visit that he had suffered from extreme chest pain the previous week and had called for help multiple times, before losing consciousness.<\/p>\n<p style=\"font-weight: 400;\">Other prisoners heard his screams and called for help. Eight hours later, prison officials came to his cell and, again, refused to take him to a doctor despite him clearly needing medical attention, intentionally denying him healthcare, sources told Freedom Initiative. Soltan, the sources said, continued to report that he was having increasing chest pains, numbness in his extremities, and limited mobility in his fingers.<\/p>\n<p style=\"font-weight: 400;\">Several sources, including former detainees, said that Soltan collapsed in his cell and was immobile on another occasion, during the first half of January 2023. Other inmates were screaming for help for approximately seven hours, all to no avail. The Badr 1 prison authorities ultimately came to him in his cell, and denied him health care, refusing to move him to a prison hospital or provide him with medications.<\/p>\n<p style=\"font-weight: 400;\">In addition to denying him access to timely healthcare, including medical examinations, prison authorities have complete discretion over provision of his vital medications and medical devices. Soltan has reported being denied medications entirely or given pills inconsistently.<\/p>\n<p style=\"font-weight: 400;\">In April 2022 and January 2023, 20 US-based medical professionals and specialists sent private letters to the Biden administration \u2014and shared them with rights groups and Egyptian officials \u2014 detailing Soltan\u2019s medical condition and the risks posed to his life by the continued denial of healthcare. In the letter, doctors assessed Soltan\u2019s condition based on his US medical history and documents and the scant information available during his detention.<\/p>\n<p style=\"font-weight: 400;\">Doctors said that Soltan is most likely suffering from coronary heart disease, poorly controlled hypertension, and kidney stones, and that his diabetes lacks \u201cobjective assessment of glycemic control.\u201d They said that Soltan is \u201cat imminent risk of developing significant complications, including cardiac events &#8212; (heart attacks, strokes, heart failure;, liver fibrosis\/cirrhosis; irreversible neurological damage; and increased risk of sudden death).\u201d<\/p>\n<p style=\"font-weight: 400;\">Soltan\u2019s\u00a0 deteriorating health condition and the continued denial of healthcare by prison authorities is particularly concerning<a href=\"https:\/\/arabi21.com\/story\/1478228\/%D8%AA%D9%88%D8%A7%D8%B5%D9%84-%D9%88%D9%81%D8%A7%D8%A9-%D8%A7%D9%84%D9%85%D8%B9%D8%AA%D9%82%D9%84%D9%8A%D9%86-%D8%A8%D9%85%D8%B5%D8%B1-%D9%88-%D8%B3%D8%AC%D9%88%D9%86-%D8%A8%D8%AF%D8%B1-%D9%8A%D9%86%D8%A7%D9%81%D8%B3-%D8%A7%D9%84%D8%B9%D9%82%D8%B1%D8%A8\"> given reports<\/a> that at least five prisoners have died in custody in Badr prison complex since June 2022 \u2013 when the authorities began transferring prisoners there \u2013 where authorities have held Soltan in a solitary cell since September 2022. Local Egyptian media recently reported that several inmates have attempted suicide in Badr prison complex<a href=\"https:\/\/thefreedomi.org\/statements\/press-release-investigate-reports-of-a-wave-of-suicide-attempts-inside-egypts-badr-prison\/\"> based<\/a>on leaked letters by prisoners about inhumane detention conditions.<\/p>\n<p style=\"font-weight: 400;\">A March 20<a href=\"https:\/\/cihrs.org\/egypt-rights-groups-warn-of-collective-punishment-at-badr-prison\/?lang=en\"> statement<\/a> by more than\u00a0 30 human rights organizations shed light on serious allegations of denial of healthcare and other abusive conditions of detention at Badr prison complex. The abuses include 24\/7 surveillance of cells with CCTV cameras, exposure to florescent lighting around the clock, and chaining prisoners to the walls of their cells without food and water for days at a time.<\/p>\n<p style=\"font-weight: 400;\">The co-signing organizations believe that the authorities\u2019 abuse of Soltan appears to be in retaliation for the human rights work of his son, Mohamed Soltan, who lives in the USA. The authorities' retaliation has included<a href=\"https:\/\/www.hrw.org\/news\/2020\/06\/24\/egypt-rights-defenders-relatives-arrested\"> detention of other family members<\/a>, and direct<a href=\"https:\/\/www.politico.com\/news\/2021\/07\/12\/egypt-spy-boss-jail-american-498983\"> threats and harassment in the<\/a> US.<\/p>\n<p style=\"font-weight: 400;\">The Egyptian authorities have recently embarked on a<a href=\"https:\/\/www.hrw.org\/news\/2021\/12\/23\/video-whitewashes-egyptian-prison-abuses\"> public relations campaign<\/a>, asserting\u00a0 that prison conditions in Egypt have improved, while<a href=\"https:\/\/foreignpolicy.com\/2021\/09\/01\/sisi-egypt-prisoners-health-human-rights-abu-al-fotouh\/\"> deliberately leaving<\/a> inmates with serious medical issues to suffer in prison, in some cases leading to death. In November 2019, following the<a href=\"https:\/\/www.hrw.org\/news\/2019\/06\/17\/egypt-independently-investigate-morsys-death\"> unexpected death<\/a> of former President Mohamed Morsi in abusive detention, United Nations<a href=\"https:\/\/www.ohchr.org\/en\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=25270&LangID=E\"> experts wrote<\/a> that due to Egypt\u2019s detention conditions, \u201cthousands more detainees across Egypt may be suffering gross violations of their human rights, many of whom may be at high risk of death.\u201d<\/p>\n<p style=\"font-weight: 400;\">In recent years the Egyptian government has deployed lobbyists to cite decades old problematic remarks by Salah Soltan to dissuade policymakers from advocating for his release, but his detention and trial in Egypt are unrelated to these remarks and solely based on his peaceful political affiliation.<\/p>\n<p style=\"font-weight: 400;\">\u00a0In recent years, the<a href=\"https:\/\/urldefense.com\/v3\/__https:\/www.appropriations.senate.gov\/imo\/media\/doc\/SFOPSREPT_FINAL.PDF__;!!Bg5easoyC-OII2vlEqY8mTBrtW-N4OJKAQ!IUbH290lQz45wM7WzXHMjBBF17rkFtiUlCxkGMOUkV7E3oPtNHErFCrmlDyy6XIQsGecyo0_knnBF3JAZ3mgot67aId4SAizsS6BsA$\"> US Congress<\/a> has<a href=\"https:\/\/www.appropriations.senate.gov\/download\/sfopsfy23rpt\"> routinely listed<\/a> Salah Soltan, along with other prisoners, in the<a href=\"https:\/\/www.appropriations.senate.gov\/imo\/media\/doc\/SFOPSFY23RPT.pdf\"> Explanatory Statements<\/a> of its annual appropriations bills as a case for the secretary of state to \u201cconsider\u201d in determining whether to certify that the Egyptian government has met specific human rights benchmarks. The statements also urged \u201cthat humane treatment and fair trials be afforded to [those specific names listed] and other prisoners in Egypt.\u201d Additionally, on the campaign trail,<a href=\"https:\/\/twitter.com\/JoeBiden\/status\/1282419453939113989\"> then-candidate Joe Biden condemned<\/a> Egypt\u2019s exile of Mohamed Soltan and the threats to his family as \u201cunacceptable.\u201d<\/p>\n<p style=\"font-weight: 400;\">The right to life is non-derogable\u2014that is, a right that cannot be suspended under any circumstances, including in times of emergencies or war \u2014and inherent to everyone, including those in custody. The Human Rights Committee, which interprets the International Covenant for Civil and Political Rights, has<a href=\"https:\/\/docstore.ohchr.org\/SelfServices\/FilesHandler.ashx?enc=6QkG1d%2FPPRiCAqhKb7yhsrdB0H1l5979OVGGB%2BWPAXhNI9e0rX3cJImWwe%2FGBLmVrGmT01On6KBQgqmxPNIjrLLdefuuQjjN19BgOr%2FS93rKPWbCbgoJ4dRgDoh%2FXgwn\"> said<\/a> that the right to life \u201cshould not be interpreted narrowly\u201d.<\/p>\n<p style=\"font-weight: 400;\">It also said that the deprivation of life involves \u201cintentional or otherwise foreseeable and preventable life-terminating harm or injury, caused by an act or omission.\u201d The obligations of states to protect lives \u201cextends to reasonably foreseeable threats and life-threatening situations that can result in loss of life.\u201d In this context, the organizations said, if Soltan dies in prison due to the systemic denial of health care and sustained ill-treatment, the authorities would be directly responsible for the arbitrary deprivation of his right to life. According to the UN Special Rapporteur on extrajudicial, summary, or arbitrary executions, \u201cviolations of the right to life stem not only from an intentional act of deprivation of life (murder) by the State\u2026, but also from State\u2019s negligence in providing basic conditions and services that guarantee life, such as access to food, water, health services and housing.\u201d<\/p>\n<p style=\"font-weight: 400;\">The USA should urge Egypt to release Salah Soltan immediately, and to seek urgent treatment for his health conditions.<\/p>\n<p style=\"font-weight: 400;\">\u201cThe Biden administration has prioritized efforts to bring home Americans who have been wrongfully detained abroad, and it is long past time for Salah Soltan to be reunited with his family in the USA\u201d said Allison McManus, the Freedom Initiative\u2019s Managing Director. \u201cAs long as Soltan remains behind bars, his American family cannot feel truly safe and secure.
